LEASE Essentials

The Lease Essentials package is designed to help you identify and understand the lease issues that could have the biggest implications for your particular business and educate you on the most important revisions you should request from your landlord. This service is designed for the small business owner or budding entrepreneur working with a limited legal budget, but may also be appropriate for business owners who are relatively savvy about real estate transactions and the law but want a "double check" on certain issues, or in cases where a business's real estate needs don't warrant a very big investment in legal services (and we'll be the first to admit, there are some cases like this - our goal is not to oversell you but rather to provide the assistance you need). You’ll receive a markup of your lease illustrating the critical provisions you should attempt to renegotiate, including suggested replacement language. The markup will be transmitted to you in a user-friendly format with clear explanations so you will understand the reasoning and stakes. From there, you will be able to move forward negotiating your lease from an educated perspective, feeling confident that the decisions and deals you're making have been vetted by an experienced leasing attorney who has tailored your lease markup and the associated guidance to your business's needs. 

$650 flat fee for lease essentials INCLUDES:

  • The Lease Shop review and analysis of your lease (and exhibits).

  • A 30-minute call with The Lease Shop to discuss your business's specific needs and how the proposed lease may affect your business goals.

  • A markup of your lease in a user-friendly format, which you can transmit to your landlord or its counsel as a redraft, or use to determine which provisions you want to focus on renegotiating. The markup will be tailored to your degree of leverage in the negotiation and edited judiciously to give you the best possible chance of obtaining improved terms from your landlord.

  • An e-mail memo from The Lease Shop detailing the critical issues with your lease, along with plain English explanations to help you reach the finish line.

Lease Essentials Plus

If your real estate is a very critical element of your business, you are an established small or mid-sized business with a reasonable legal budget (or if you're a startup with funds set aside for legal services - kudos to you for your thorough initial business plan!), or if you would simply prefer to pass on the task of negotiating with your landlord or its counsel, Lease Essentials Plus may be the right option for you. In addition to everything that is included in the Leases Essentials package detailed above, The Lease Shop will conduct a negotiation session with your landlord or its counsel on your behalf. Afterward, we will either revise your lease, or if the landlord insists on controlling the document, we will review the product of the negotiation session to ensure all revisions are captured accurately. With Lease Essentials Plus, you will gain leverage in your negotiations by virtue of having a lawyer on your side. And you will skip the time and stress involved in negotiating so you can focus on your business.

$1400 flat fee for lease essentials plus INCLUDES:

  • The Lease Shop review and analysis of your lease (and exhibits)

  • A 30-minute call with The Lease Shop to discuss your business's specific needs and goals in relation to your lease.

  • A markup of your lease, which you will transmit to your landlord. The markup will be tailored to your degree of leverage in the negotiation and edited judiciously to give you the best possible chance of obtaining improved terms from your landlord.

  • The lease markup will be accompanied by an e-mail memo outlining The Lease Shop's assessment of the most critical provisions you may want to negotiate with your landlord based on our experience and what you've told us about your business's specific priorities. The memo will include easily understandable explanations and options for compromise, and we will discuss it with you to aid you in making the decisions involved with your lease negotiation.

  • 2 hours of negotiation and follow-up time.

  • The Lease Shop will either (a) prepare a revised version of your lease reflecting the negotiated terms, or (b) if the landlord insists on controlling the document, The Lease Shop will review (and edit, if necessary) the revised version prepared by your landlord to ensure it accurately reflects the negotiated terms.

Your initial lease markup and e-mail memo will be delivered to your e-mail inbox within 3 business days of your initial call with The Lease Shop. The total time required to complete the Lease Essentials Plus scope of work will be dependent upon the availability and cooperation of your landlord and its counsel.

The Lease Shop’s Complete Representation service includes full review, revision, and negotiation of your lease - no matter how many rounds it takes. This option may be desirable if you are an established business seeking retail, office, or industrial leasing assistance, whether you’re leasing one or a few critical spaces. Or you may desire Complete Representation if your business has established legal and risk management policies that include certain imperatives typically requiring more than one round of negotiation and revision of a lease. A Complete Representation may also be the right fit if you're too busy to manage (or uncomfortable handling) the leasing process, or if you are dealing with a very difficult or sophisticated landlord employing expert counsel working against your interests. We take the tedious legwork and stressful back-and-forth off your plate so you can spend your time where it matters most - on your business.

The Lease Shop also offers custom packages for franchisors and tenant-side businesses with portfolios of leased properties. We can put together a volume-based pricing proposal including any components of leasing and lease-related services you’d like to outsource.
